Ron Paul Shocks Campaign Staff With New Position On Israel

April 21, 2012  Republican presidential hopeful Ron Paul revealed this week that he would support moving the U.S. Embassy in Israel to Jerusalem, a surprising position that contradicts conventional wisdom about Paul's stance toward the Jewish state. 
Paul first made this position known Wednesday night, during a private meeting with evangelical leaders interested in helping the Texas Congressman reach out to the conservative Christian community. 
According to a transcript of the meeting obtained by Business Insider, the leaders started off the meeting by asking Paul whether he would sign an Executive Order to move the U.S. Embassy in Israel from Tel Aviv to Jerusalem, a major policy objective for Israeli hardliners and many leaders in the Christian Right. 

"The real issue here is not what America wants, but what does Israel want," Paul told evangelical leaders, according to a transcript of the meeting obtained by Business Insider. "If Israel wants their capital to be Jerusalem, then the United States should honor that." 

"How would we like it if some other nation said 'We decided to recognize New York City as your capital instead, so we will build our embassy there?'" he added. 

Even Paul's senior campaign aides were surprised by his response. 

"We were floored," senior advisor Doug Wead told Business Insider. "It sounds like pure Ron Paul, but it still caught us off guard...If someone would have asked him that in a national debate, I suppose it would have popped right out, but nobody did!"
Wead added that Paul's position "makes sense after the fact," noting that the candidate has frequently emphasized Israel's sovereignty. 

Still, Paul's stance will likely come as a surprise to GOP leaders, most of whom view Paul's non-interventionist foreign policy ideas — and particularly his stance towards Israel — as his greatest weakness. The septuagenarian Congressman has largely been snubbed by the right-wing Jewish community, and was even excluded from a December presidential candidates' forum hosted by the Republican Jewish Coalition because of his "misguided and extreme" foreign policy views.

"I appreciate what he said about Israel — as a matter of fact, I was pleasantly surprised," Brian Jacobs, a Texas pastor who attended Wednesday's meeting, told Business Insider. "It helped answer a lot of questions that I had." 

Ironically, Paul and Newt Gingrich are now the only presidential candidates who have said that they are in favor of recognizing Jerusalem as the capital of Israel and moving the U.S. Embassy there. President Barack Obama has postponed moving the Embassy. Romney "would like to see the U.S. Embassy eventually moved to Jerusalem," campaign spokesman Andrea Saul said in a statement emailed to Business Insider. 

While Paul's position is unlikely to change the near-certain outcome of the Republican primary, it could help Paul gain support among evangelical leaders, many of whom have been hesitant to support Romney. Jacobs, who has worked as a consultant for televangelist Billy Graham, told Business Insider that several evangelical leaders have started to express interest in talking to Paul in the wake of Rick Santorum's departure from the race.

Jacobs said he is now working with the Paul campaign to organize conference calls between the candidate and evangelical leaders. Christian television producer Justin Machacek, who also attended Wednesday's meeting, said he is working on arranging a larger meeting between Paul and other conservative Christian groups. 

A relationship with Christian Right powerbrokers could give Ron Paul more leverage within the party, as Romney tries to unite the GOP after this year's divisive primary fight. It could also help broaden the Paul coalition, setting the stage for a future run by Paul's son, U.S. Sen. Rand Paul

"100% of Christian leaders that I've talked to, do you know the one thing they like about Ron Paul? His son Rand Paul," Jacobs told Business Insider. "Every Christian leader will say, 'You know I'm not quite sure if Ron Paul can win the nomination'…but in the same breath, they tag it with, "But I sure do like the way his son has followed him.'"

Ron Paul’s Position on Israel is a Betrayal of His Values

Doug Wead, a senior advisor to the Ron Paul campaign, writes in his blog that Ron Paul was asked by evangelical leaders about moving the U.S. embassy in Israel from Tel Aviv to Jerusalem. “The real issue here is not what America wants but what Israel wants,” Dr. Paul told them, according to Wead. “We have no right to choose their capital…. If they say it is Jerusalem, then it is Jerusalem.” Wead summarizes Dr. Paul’s position as: “Jerusalem is the capital of Israel. Get over it.”

Ron Paul’s position, as reported by Mr. Wead, is morally and legally wrong, as well as strategically mistaken. Dr. Paul has stood out as a presidential candidate precisely because of his unwavering consistency and incorruptibility, the only one who is not willing to betray his values to win votes or pander to the lobbies. His statement on Jerusalem is extremely damaging to that reputation, and will no doubt give rise to the charge that he has sold his soul to the “Israeli lobby”.

If we give him the benefit of the doubt and assume his position is sincere, that he has not said this merely to win some votes, then we must assume that Dr. Paul is just not very well read on the Israeli-Palestinian conflict. It is not the first time that he has been wrong in his views regarding Israel. His campaign often touts that he was the only one to defend Israel’s bombing of Iraq’s Osirak nuclear reactor in 1981, which is entirely inconsistent with his correct observation that “Another term for preventive war is aggressive war—starting wars because someday somebody might do something to us.”

Israel’s attack was not a “preemptive” act of self-defense, but an act of aggression, “the supreme international crime”, as defined at Nuremberg. The IAEA had been monitoring Iraq’s program, and there was no evidence at that time of any weapons program. Israel was only nation in the Middle East that actually possessed nuclear weapons (which remains true), and its attack was condemned by the United Nations Security Council in Resolution 487, which noted that “Iraq has been a party to the Treaty on the Non-Proliferation of Nuclear Weapons [NPT] since it came into force in 1970, that in accordance with that Treaty Iraq has accepted IAEA safeguards on all its nuclear activities, and that the Agency has testified that these safeguards have been satisfactorily applied to date”. Far from making the world safer from the threat of nuclear weapons proliferation, the international community, in strongly condemning Israel’s attack as a “clear violation of the Charter of the United Nations and the norms of international conduct”, found that Israel’s attack constituted “a serious threat to the entire IAEA safeguards regime which is the foundation of the non-proliferation Treaty”.

While there’s no evidence Israel’s attack prevented Iraq from acquiring a nuclear weapon, according to U.S. intelligence, it was likely an important factor that played into Saddam Hussein’s subsequent decision to move his nuclear program underground and seek to develop an Iraqi nuclear deterrent to further Israeli aggression. An interagency intelligence assessment on the consequences of Israel’s attack stated that it “could be a watershed event in the Middle East” by adding “new strains” to “US-Arab relations” and sparking an “arms race” in which “Arab leaders will intensify their search for alternative ways to boost their security and protect their interests” (much the same observation that Rafsanjani made in 2001). Israel’s own possession of nuclear weapons made its actions all the more destabilizing. Israeli Defense Minister Moshe Dayan had “dispelled the ambiguity that surrounded Israel’s nuclear program by acknowledging Israel’s capability to produce nuclear weapons, and the raid on Iraq has laid Tel Aviv’s challenge before the Arab world in clear terms.” Saddam Hussein responded “by suggesting that world governments provide the Arabs with a nuclear deterrent to Israel’s formidable nuclear capabilities. His message to other Arabs is that they can have no security as long as Israel alone commands the nuclear threat.” In line with the view of the international community as reflected in the U.N. resolution, the assessment stated that Israel’s attack seriously damaged international efforts to prevent the proliferation of nuclear weapons. “A related consequence of the raid is damage to the Non-Proliferation Treaty (NPT) and to the IAEA safeguards system”, which would “probably have a detrimental impact”. Contrary to Israeli assertions “that the IAEA safeguards system is a sham”, the assessment made a similar observation as the U.N. resolution that “The Iraqis have had the support of most IAEA members because of general acceptance that international and bilateral safeguards over Iraq’s program were sufficient to guard against the diversion of fissile material for a nuclear device.”

Ron Paul’s suggestion that the U.S. should recognize Jerusalem as the capital of Israel is likewise a disappointing defense of lawlessness that would seem to indicate that Dr. Paul is unfamiliar with the history of the Israeli-Palestinian conflict and rather bases his views on the establishment-approved mythical narrative, which is essentially the history as it is presented in Zionist propaganda.

The truth is that following the Zionists’ unilateral declaration of the existence of the state of Israel in May 1948, an act prejudicial to the rights of the majority inhabitants and for which there was absolutely no legal basis, Palestine was ethnically cleansed. More than 700,000 Arab Palestinians were expelled or fled from their homes, never allowed to return. The Zionist forces captured Jerusalem, and when an armistice was finally reached in 1949, Israel controlled the west and Jordan the east of the city.

In 1967, Israel invaded and occupied the West Bank and claimed to annex East Jerusalem. Subsequently, the United Nations Security Council passed resolution 242, which emphasized “the inadmissibility of the acquisition of territory by war”, emphasized that member states have a commitment to abide by the U.N. Charter, and called for the “Withdrawal of Israeli armed forces from territories occupied” during the June 1967 war.

In May 1968, the Security Council passed resolution 252, which declared Israel’s annexation of Jerusalem “invalid” and called upon Israel “to rescind all such measures already taken and to desist forthwith from taking any further action which tends to change the status of Jerusalem”.
In July 1969, the Security Council passed resolution 267, noting that Israel had since “taken further measures tending to change the status of the City of Jerusalem”. It reaffirmed “the established principle that acquisition of territory by military conquest is inadmissible” and deplored Israel’s further violations of U.N. resolutions, censured “in the strongest terms all measures taken to change the status of the City of Jerusalem”, and confirmed “that all legislative and administrative measures and actions taken by Israel which purport to alter the status of Jerusalem, including expropriation of land and properties thereon, are invalid and cannot change that status”, and urgently called on Israel to rescind the measures taken to annex Jerusalem.
Security Council 271 of September 1969 again reaffirmed the principle of the inadmissibility under international law of the acquisition of territory by war, describing Jerusalem as being under “military occupation” by Israel and condemning Israel’s continued violation of previous resolutions.

Resolution 298 of September 1971 again reaffirmed the principle, deplored Israel’s continued violation of U.N. resolutions, and confirmed that Israel’s attempts to annex Jerusalem “are totally invalid”.

Resolution 446 of March 1979 affirmed “once more that the Fourth Geneva Convention … is applicable to the Arab territories occupied by Israel, including Jerusalem“, determined “that the policy and practices of Israel in establishing settlements in the Palestinian and other Arab territories occupied since 1967 have no legal validity” (emphasis added).

Resolution 452 of July 1979 again deplored Israel’s continued violation of Security Council resolutions and again emphasized that Israel’s annexation of Jerusalem “has no legal validity and constitutes a violation of the Fourth Geneva Convention”. It again also noted that Jerusalem is included in “the occupied Arab territories”.

Resolution 465 of March 1980 again condemned Israel’s settlement policy, which violates the Fourth Geneva Convention and U.N. Security Council resolutions, and again reaffirmed that Israel’s annexation attempts “have no legal validity” and constitutes “a flagrant violation of the Fourth Geneva Convention”.

Resolution 471 of June 1980 once again reaffirmed the applicability of the Fourth Geneva Convention “to the Arab territories occupied by Israel since 1967, including Jerusalem“, and once again called upon Israel to end its illegal occupation of those territories, including Jerusalem.

Resolution 476 of June 1980 again deplored Israel’s continued violation of international law and reaffirmed “the overriding necessity to end the prolonged occupation of Arab territories occupied by Israel since 1967, including Jerusalem”, and reaffirmed Israel’s annexation measures “have no legal validity and constitute a flagrant violation of the Fourth Geneva Convention” and were “null and void”.
Resolution 478 of August 1980 again censured Israel’s continued violation of international law and again reaffirmed that its annexation attempts were “null and void”.

Resolutions 592 of December 1986, 605 of December 1987, 607 of January 1988, 636 of July 1989, 694 of May 1991, 726 of January 1992, 799 of December 1992 all again reaffirmed the applicability of the Fourth Geneva Convention to occupied Arab territory, including Jerusalem.
In July 2004, the International Court of Justice issued an advisory opinion on the legal consequences of Israel’s decision to build a wall in the West Bank, including Jerusalem, which concluded that “all these territories (including East Jerusalem) remain occupied territories and that Israel has continued to have the status of occupying Power”, that the construction of the wall in those territories is “illegal”, and that Israel’s settlements in the West Bank, including Jerusalem, similarly “have been established in breach of international law.”

Ron Paul’s defense of Israel’s Osirak attack and his statement on Jerusalem are inconstant with his beliefs in individual liberty and the rule of law, which is unfortunately damaging to his credibility and to his presidential campaign.

One must keep in mind that of the candidates, Ron Paul is also the only one who has said he would cut off all foreign aid, including the $3 billion plus given annually to Israel. This is not trivial, given the fact that without U.S. support, Israel’s criminal policies against the Palestinians could not continue. Ron Paul is the only one who has criticized Israel’s siege of Gaza and the massacre it carried out there from December 27, 2008 to January 18, 2009. He is unquestionably a preferable candidate than Newt Gingrich, who has said that Palestinians are an “invented” people. Or Mitt Romney, who has pledged that if elected president, he will “begin discussions with Israel to increase the level of our military assistance and coordination”. Or Barack Obama, who told his Israeli audience in Sderot during his presidential campaign in July 2008 of his “unshakeable commitment” to Israel, and who declared that “Jerusalem will be the capital of Israel”.

It is a disturbing development in Ron Paul’s campaign to see him sounding on this issue more rather than less like his establishment opponents.

Is Ron Paul part of a US-BP Iran War plan?

Was the notorious "Islam Bomb" cartoon, published across Europe in 2006, part of an aborted false flag world war plan? 

(The article below is my revision and republication of an article by Dr. James H. Fetzer, originally published in Scholars for 9/11 Truth on February 2, 2008.)
In 2006 a former Army intelligence officer detected evidence that a false flag nuclear operation would be carried out against the British Petroleum refinery in Texas City, Texas, part of Ron Paul's Congressional district, on January 31, 2006.
Captain Eric H. May, a former NBC editorial writer whose political and military essays had appeared in The Wall Street Journal, The Houston Chronicle and Military Intelligence Magazine, issued a series of warnings through alternative media interviews and articles. The mainstream media at first ignored them, but were compelled to report them when a day-after nuclear response team arrived and set up operations in Paul's district on February 1, 2006 -- the day after Captain May's predicted attack date of January 31.

Galveston County Daily News reporter T.J. Aulds had long been suspicious of the repeated explosions at the BP refinery, the nation's most toxic industrial site. In Nuclear attack warning story dismissed, published on February 2, 2006, he wrote:
If you are reading this, you survived a predicted nuclear attack on Texas City.  Recent weeks have seen the city mentioned as the subject of rampant Internet and e-mail claims suggesting that emergency management officials were preparing for some form of attack.
Officials with several agencies said those reports are false. Shauna Dunlap, a spokesman for the FBI, said that there are “no credible or corroborated threats to the area.”
That attack was to have taken place Tuesday, based on those reports. A report filed on the Arctic Beacon web site as well as the site owner’s Internet radio show had warned of a pending nuclear attack on the city — not from terrorists, but the federal government.
Basing his information on a report from a man claiming to be a former U.S. Army intelligence officer, show host Greg Szymanski reported that the area was likely the target for a government-led nuclear attack. The report quickly made the rounds via e-mail and blog sites.
Despite the headlined dismissal, Aulds' own reporting seemed to confirm the nuclear attack warning story:
On Wednesday, people driving along Galveston’s Seawall Boulevard could see unmarked black trucks and sport utility vehicles bearing government license plates near crews setting up what appeared to be satellite or radar gear on the beach. . . . The crews were wearing shirts embossed with the words, ‘Weapons of Mass Destruction Civil Support Team,’ a branch of the U.S. Defense Department. It was enough to get even the most timid conspiracy theorist thinking something was up.
Greg Szymanski, a noted investigative journalist, wrote a gripping series of articles about May's false flag forecast for The Arctic Beacon, beginning the week before events bore him out. Rather than rely on Bush administration officials, he turned to reputable Texas City insiders, especially a British Petroleum employee and a local minister.  He wrote
Jan. 25, 2006: All Signposts Lead To Imminent Nuclear Attack In America -- Intel Army Capt. Eric May Issues 'Red Alert' For Next 9 Days For Texas City-Houston Area.  Capt. May claims to have broken the Illuminati and Bush Cabal's "embedded code" in an effort to beat the neocons at their own nasty game. Capt. May may have thwarted one attempted nuclear attack last July, but says the Bush Cabal is coming back again for a second try. 
Jan. 26, 2006: Houston PD Running Nuclear Disaster Drills -- As Build-Up Of Numerous Law Enforcement Agencies Seen In Nearby Texas City.  Army Intel Capt. Eric May warns Bush cabal days away from a nuclear strike. Texas City resident "opens up a hornet's nest" as he warns local law enforcement about the possibility of nuclear strike. 
Jan. 28, 2006: Texas City British Petroleum Claims No Foul Play -- In 2005 Explosion Killing 15; BP Sets Aside $1 Billion For Upgrades Amid Rumors Neocons Plan To Nuke Plant In Upcoming Days.  Some Texas City citizens taking nuke warning seriously as local law enforcement build-up seen and at least 400 employees moved out of BP to different office building. 
Feb. 3, 2006: Texas City British Petroleum Employee Heard "Strange Abort Signal" on Local Radio Station --The Morning Army Intel Officer Predicted Nuclear Strike At Plant.  BP employee also said "other strange events" occurred, leaving her "nervous and on edge." Galveston Daily News follows up with story, finding WMD military support team was conducting a training session at a location near Texas City.
Citizens who have read Captain May's articles about false flag attempts in the East Texas oil patch urged him to contact Ron Paul with the details.  Some tried to contact the congressman themselves, but thus far to no avail.  A fair number of them believe that it was the Bush administration's design on Texas City that prompted Paul's 2008 presidential bid, while others believe that Paul is a part of the false flag plan.
May has noticed a pattern ithe selection of targets for attacks, including New York City in New York, Oklahoma City in Oklahoma, and now Texas City in Texas

“Anticipating what they are going to do next is not rocket science,” he observed, “but it requires patience and attention to detail.  Let's hope that we will be as successful in thwarting other attacks by our own government as we were in this instance.”

Dr. Jim Fetzer has featured Captain May as his guest on “The Dynamic Duo” several times and takes his analyses seriously.
“I wish I could tell you that he’s wrong," Fetzer said, "but the evidence we have discovered about 9/11 suggests that this administration has no scruples when it comes to sacrificing innocent lives to advance its political agenda.”

Dr. Kevin Barrett, who has closely followed May’s research, also believes that these signs have to be taken seriously.

“In the Texas City, Texas, case, even the mainstream media reported indications that strange events were in the works," Barrett said, "including unmarked black trucks and sport utility vehicles bearing government license plates near crews setting up what appeared to be satellite or radar gear on the beach, and the crews were wearing shirts that said, ‘Weapons of Mass Destruction Civil Support Team.’  We may have been very lucky that Captain May sounded the alarm,” Barrett said.  “My impression is that Captain Eric May is one of the bravest and most eloquent intelligence analysts in the United States today. It is regrettable his state of health has deteriorated to the point that we are not going to be able to count on his research much longer.”

The timing of the apparent false flag attempt, which May supposed would occur in the hours before Bush's January 31, 2006 State of the Union Address, explains an otherwise inexplicable series of events:
February 1-2: A dozen cartoons attacking Islam are published across Europe. According to prolific scholar James Petras, in January Mossad activated media sayanim (helpers) to reproduce the cartoons on February 1-2. The cartoons, especially one linking Islam to a bomb, were probably designed to be wartime propaganda to follow a false flag nuclear attack against Texas City.

February 1: The Synthron petrochemicals plant explodes and burns in what could have been a large-scale catastrophe. Katherine Torres' article, North Carolina Workers Alive Because of Possible Pre-Explosion Warnings, has all the clues necessary to infer that Synthron, like BP, was a target in the aborted false flag operation.

February 6-10: The first international, inter-agency and industry-wide Internet terrorism exercise, and Cyber Storm occurs, and was probably intended to support the Global War plan. The difficulty in finding articles about it is disquieting, with the upcoming National Level Exercise, 2012 taking cyber operations to the highest level yet, and presenting the same danger of going live to support a war on Iran.

February 14: The Washington Times runs a scathing editorial, Arab-owned American ports?, condemning the Bush administration's bizarre decision to turn over the management of several U.S. ports to a United Arab Emirates company, Dubai Ports World. The fiasco is attributed to presidential bungling, but a more plausible explanation is that the UAE was to provide key logistical support for the intended war on Iran.

February 21: Bush threatens to veto any Congressional attempt to block the Dubai Ports World deal. It will be his first veto, and his determination sets him against public opinion and the legislative branch.

February 22: An alleged Al Qaeda bombing destroys the Mosque of the Golden Dome, one of the most important sites to Shiite Muslims. In Iraq the act of terrorism sparks internecine conflict between Shiites and Sunnis, while in the U.S. it allows the Bush administration to shift public scrutiny away from its shady dealings with the UAE.

Crossing the line at the border

Eight people have been killed along the border in the past two years. One man died a short time after being beaten and tased, an event recorded by two eyewitnesses whose video is the centerpiece of the report. Both eyewitnesses say the man offered little or no resistance. One told Need to Know that she felt like she watched someone being “murdered,” and the San Diego coroner’s office classified the death as a “homicide.”

The Ron Paul Campaign is infiltrated, Sabotaged and Compromised.

I do not question the integrity of congressmen Ron Paul. I do not question his patriotism or his character. But I do question the people around him and how they are insulating him from his support base. If I were Ron Paul and a few really trusted people without an agenda to undermine the campaign. There needs to be a shake up in the campaign to weed out the hacks and operatives who have infiltrated the leadership positions.
The campaign has not been running TV and radio ads even though they had the funds to pay for these ads. He is getting bad advice from the wrong people who are there to mislead the Texas congressmen. It is time to expose the traitors inside the campaign sent by the republican party and possibly Carl Rove to undermine any chances of Ron Paul getting any victory. These are the people who are holding back the campaign. Thank God the Grassroots are not following orders from headquarters. They are grabbing the bull by the horns making an impact in the state convention prior to the gathering in August.

1- Blackwater agents posing as media. Does this mean these people might be hired assassins.

2. Israel firster Attorney Bruce Fien is close to Ron Paul now as legal advisor.

4.  Shortly prior to the Iowa Caucus in 2012. Doug Weed was on national Television say we need volunteers to watch the polls in Iowa being election observers. There was another letter released from Ron Paul’s Facebook page saying “The Ron Paul campaign tell people to stay away from Iowa that it is all taken care of.”

5. There is no challenges to election fraud in Maine, Nevada and South Carolina when the fraud was obvious.

 6. There was no legal challenges from the Paul Campaign when the Iowa RNC counted the ballots in secret instead out in public view.

7. If there were TV ads, they were very weak. No campaign ads talking about abolishing the TSA and nullifying the NDAA. Real issues that resonated with the American people.

8. Dr Stan Monteith confirmed there are infiltrators inside the Ron Paul campaign with a mission to naturalize the liberty movement to preserve the status quo.

9.  A Former Ron Paul campaign staffer confirmed that the Campaign has been infiltrated with neo cons.

10. I was listening to Jim Condit Jr on the Jeff Rense show in a rebroadcast show(7_04-2012) talk about a talk radio station in Ohio wanting to get Ron Paul on the air for an interview. The Ron Paul campaign never returned their calls to arrange Ron Paul to come on for an interview.
Ron Paul is a threat to the establishment, the power structure wants to make sure the Ron Paul does not win. I just think the powers that be have overplayed their hand. Anything is possible. I have not written Ron Paul off just yet. I do not know what he has up his sleeve. With delegates being acquired from state to state. Anything is possible.
I just hope Ron Paul deals with the saboteurs inside the campaign. He can no longer be a gentleman or a nice guy. The other side exploits that as a weakness they can take advantage of. Until the campaign starts vetting the people to work the campaign are screened and checked out. There will always be trouble with no sign of victory in sight and freedom will be lost forever.

TRIBUNAL TO HEAR SECOND WAR CRIME CHARGE AGAINST BUSH AND ASSOCIATES
 
KUALA LUMPUR, 12 April 2012 - The Kuala Lumpur War Crimes Tribunal will be hearing the second charge of Crime of Torture and War Crimes against former U.S. President George W. Bush and his associates namely Richard Cheney, former U.S. Vice President, Donald Rumsfeld, former Defence Secretary, Alberto Gonzales, then Counsel to President Bush, David Addington, then General Counsel to the Vice-President, William Haynes II, then General Counsel to Secretary of Defense, Jay Bybee, then Assistant Attorney General, and John Choon Yoo, former Deputy Assistant Attorney-General. The charge reads as follows: The Accused persons had committed the Crime of Torture and War Crimes, in that: The Accused persons had wilfully participated in the formulation of executive orders and directives to exclude the applicability of all international conventions and laws, namely the Convention against Torture 1984, Geneva Convention III 1949, Universal Declaration of Human Rights and the United Nations Charter in relation to the war launched by the U.S. and others in Afghanistan (in 2001) and in Iraq (in March 2003); Additionally, and/or on the basis and in furtherance thereof, the Accused persons authorised, or connived in, the commission of acts of torture and cruel, degrading and inhuman treatment against victims in violation of international law, treaties and conventions including the Convention against Torture 1984 and the Geneva Conventions, including Geneva Convention III 1949.
The Kuala Lumpur War Crimes Commission (KLWCC) following the due process of the law is bringing this charge against the accused. In 2009, the Commission, having received complaints from torture victims from Guantanamo and Iraq, proceeded to conduct a painstaking and an in-depth investigation for close to two years. Two charges on war crimes were drawn and filed against the accused persons.

The Kuala Lumpur War Crimes Tribunal had heard the first charge in November 2011 against the two accused, former U.S. President George W. Bush and former British Prime Minister Anthony L. Blair who were after a 4-day trial found guilty of Crimes Against Peace. These two former heads of state violated the United Nations Charter and international law when they planned, prepared and invaded the sovereign state Iraq on 19 March 2003 without just cause.

At the first hearing in November 2011, the Tribunal had permitted the prosecution’s application to hear only the first charge. The second charge will now be heard at the second Tribunal hearing from 7 – 12 May 2012.

The Kuala Lumpur War Crimes Tribunal is constituted of eminent persons with legal qualifications. The judges of the Tribunal, which is headed by retired Malaysian Federal Court judge Tan Sri Dato Lamin bin Haji Mohd Yunus, who also served as an ad litem judge at the International Criminal Tribunal for the former Republic of Yugoslavia, include other notable names such as Mr Alfred Lambremont Webre, a Yale graduate, who authored several books on politics, Tunku Sofiah Jewa, practising lawyer and author of numerous publications on International Law, Prof Salleh Buang, former Federal Counsel in the Attorney-General Chambers and retired Court of Appeal judge Datuk Mohd Sa’ari Yusof.

Point to note is that victims of torture will also be called give evidence before the Tribunal. The cries of these victims have thus far gone unheeded by the international community. The fundamental human right to be heard has been denied to them. These witnesses will testify on the torture they had endured during their incarceration. The accused will have a right to cross-examine them as in any open court hearing.

The Tribunal will adjudicate and evaluate the evidence presented as in any court of law. The judges of the Tribunal must be satisfied that the charges are proven beyond reasonable doubt and deliver a reasoned judgement.

In the event the tribunal convicts any of the accused, the only sanction is that the name of the guilty person will be entered in the Commission’s Register of War Criminals and publicised worldwide. The tribunal is a tribunal of conscience and a peoples’ initiative.

The prosecution for the trial will be lead by Prof Gurdial Singh Nijar, prominent law professor and author of several law publications and Prof Francis Boyle, leading American professor, practitioner and advocate of international law, and assisted by a team of lawyers.

The trial will be a public hearing held in an open court on 7-12 May 2012 at the premises of the Kuala Lumpur Foundation to Criminalise War (KLFCW) at 88, Jalan Perdana, Kuala Lumpur. The hearing is open to members of the public.
